Plaintiffs—the American Association of University Professors (“AAUP”), three AAUP campus chapters, and the Middle East Studies Association—filed this lawsuit challenging the Trump administration's implemented policy of “ideological deportation,” comprised of large-scale arrests, detentions, and deportations of noncitizen students and faculty who participated in pro-Palestinian protests and other related forms of expression and association. Plaintiffs argue that the ideological-deportation policy and related threats violate the First and Fifth Amendments, as well as the Administrative Procedure Act (“APA”).
On April 1, the plaintiffs filed a motion for a preliminary injunction ("PI") and a motion for an expedited briefing schedule, arguing that the Trump Administration’s continuing use of the ideological-deportation policy required quick resolution of the PI motion. The court agreed to expedite the briefing schedule and ordered both parties to submit responsive filings by April 21. A hearing on the preliminary injunction motion will be held on April 23, 2025.
