Summary

In this case, three individuals and four immigrant-serving nonprofit organizations (Las Americas Immigrant Advocacy Center, RAICES, American Gateways, and Americans for Immigrant Justice) originally filed suit on February 12, 2025 to challenge the Trump Administration’s policies under which noncitizens are flown to (and detained in) Guantanamo Bay, Cuba, pending their deportation to other countries. Plaintiffs (represented by the ACLU, the Center for Constitutional Rights, and the International Refugee Assistance Project) remain detained in Cuba and subsequently amended their complaint on April 26, 2025, to challenge the administration’s restrictions on their ability to communicate with legal counsel, their family members, and the outside world, as well as the unduly punitive conditions of their confinement. They also moved to certify a class of all immigration detainees originally apprehended in the United States who have been or will be held in Guatanamo Bay, Cuba.

Technical Summary: 

The amended complaint filed on April 26, 2025 brings a First Amendment Claim to challenge the restrictions on their ability to communicate and associate with legal counsel, family members, and the outside world. The complaint also brings a Fifth Amendment substantive due process claim challenging the conditions of their confinement. The Plaintiffs have moved to certify a class of similarly situated individuals under Rule 23(b)(1) and (b)(2).
